General conditions of participation General conditions of participation for competitions and competitions from BITHOUSE GROUP INC / UNITED17 Ventures UG. 1. Scope The General Conditions of Participation apply to competitions, competitions and similar campaigns (hereinafter referred to as "campaign"), especially in the online area, which are organized by BITHOUSE GROUP /UNITED17 Ventures UG, Strelitzer Strasse 2 Berlin, Germany (hereinafter referred to as "promoter"). 2. Reference to special conditions of participation Each individual campaign has special conditions of participation, which can be found in the text for the campaign. The special conditions of participation contain information about the course of the campaign, participation deadlines, prizes, and the terms of winners / winner determination. The special conditions of participation for the respective campaign refer to the general conditions of participation, but take precedence over them. 3. Participation / Exclusion Participation and the chance to win are free and independent of the purchase of a product from the organizer or affiliated companies. a. Minimum age The minimum age to participate is 18 years. b. Territorial restrictions Only persons with permanent residence in USA, Germany, Austria, or Switzerland are eligible to participate, unless otherwise stated in the special conditions of participation. c. Exclusion in the case of multiple participations, bulk submissions or other manipulation The organizer reserves the right to exclude multiple entries (e.g. under several names, accounts or e-mail addresses) or in this regard conspicuous submissions or bulk submissions, for example from competition sites or competition clubs, from the promotion. Also excluded are people who (try to) gain an advantage through the use of unauthorized aids or technical manipulations. d. Exclusion in the event of a violation / important reason A violation of these conditions of participation entitles the organizer to exclude the participant from participation without prior notice. e. Exclusion from events If the price is an event (concert, etc.), only natural persons who are actually able to attend the event on the day of the event at the respective location are entitled to participate. In particular, winners who have not yet reached the age of 16 will only be admitted to concerts if they are accompanied by a legal guardian or a person authorized by them. Instructions of the security staff and the employees of the organizer in connection with the action on site must be followed. f. Exclusion due to non-consent to the conditions Persons are also excluded from participation if or as soon as consent to the Special and / or General Conditions of Participation and the data protection provisions is not given or revoked. g. Participation in your own name / no transfer Participation can only take place in your own name. The entitlement to the prize is not transferable. 4. Provisions on individual types of prizes The following rules generally apply to certain types of prizes. Insofar as no other specifications are made in the special conditions of participation for the respective competitions / competitions, the winner can only demand the service described here. a. Ticket win If the prize includes one or more tickets, the tickets will be sent by post to the address specified by the winner or sent as an electronic ticket to the specified e-mail inbox. In addition, tickets can also be deposited at the venue. In the case of guest list places being allocated, the respective concert organizer will be notified of the names of the winners and any accompanying persons to be named by the winner. Winners and accompanying persons must ensure that they can identify themselves on site. The organizer has no influence on postponements or cancellation of music pitch concerts. In such a case, the organizer reserves the right to determine an adequate profit as an alternative. The conditions of the respective concert/event organizer and ticket provider apply to the implementation of the concert (procedure, granting of access). b. Non-cash profit Prizes in kind will be sent by the organizer or third parties via postal service, shipping company or similar to the address specified by the winner. The organizer bears the shipping costs to the winner's place of residence, although the place of performance remains the organizer's place of business. The illustration of the prizes in kind on the competition page is only an example. The individual prizes may differ in color, design, etc. from the example model shown. The organizer is entitled to select an item of medium quality and appropriate to the sample model. c. Travel profit Travel prizes are carried out by the organizer or third parties (sponsors / tour operators or similar). If third parties are involved, they are entrusted with the sole implementation of the trip. The conditions of the respective tour operators, sponsors etc. apply. The winner must ensure that he has all the travel documents pertaining to the person, in particular valid IDs and, if necessary, visas at the start of the journey. The course of the trip - especially travel dates - will be agreed between the organizer and the winner. The winner has no right to travel on a specific date. The organizer only bears those costs that are explicitly stated in the text of the respective competition. Other costs, such as meals or the like, are not included in the profit. d. On Location (at home) Pitch / Performance On Location pitches / performances will be hosted by the participants and/or winners at the specified time at the named residence of the winner. The maximum number of visitors is 20, including the winner. In the event of unforeseeable obstacles that prevent the living room pitch /performance concert from being carried out, the organizer can postpone the concert. If the winner cannot keep the agreed date for the on location pitch /performance, there is no entitlement to postpone the on location pitch/performance to another time. The organizer only bears those costs of the on location pitch /performance that are explicitly stated in the text of the respective competition. Any additional costs are borne by the semi- finalists / winner themselves. The semi-finalists / winners transfers to the organizer all rights to picture and sound recordings made during the on location pitch / performance. e. Beyond the Music Label Podcast The podcast series is hosted by the organizers of the series at a specified time. Third party operators help with editing of the podcast. In the event of unforeseeable obstacles that prevent the recording of the podcast, the organizer can cancel and reschedule the podcast recording and delivery. f. Beyond the Music Label (TM) Playlist Curation and production of the Beyond the Music Label (TM) Playlist are carried out by the organizer or third parties (sponsors / playlist operators). If third parties are involved, they are entrusted with the sole implementation of the playlist and distribution. The conditions of the respective playlists, sponsors, supporters etc. apply. The participant must ensure that their music is free and clear to be distributed via the pitch /competition playlist, performance venues etc. The organizer only bears those costs that are explicitly stated by third party listing platforms. Other costs, such as music clearance rights of semi-finalists or finalists music pitched, performed or listed via the playlists are not paid by the organizer. d. On Location (at home) Pitch / Performance On Location pitches / performances will be hosted by the participants and/or winners at the specified time at the named residence of the winner. The maximum number of visitors is 20, including the winner. In the event of unforeseeable obstacles that prevent the living room pitch /performance concert from being carried out, the organizer can postpone the concert. Data Personal data such as name, date of birth, address and / or e-mail address and / or telephone number are regularly required to carry out the campaign. The participant is responsible for the correctness of the contact data he has provided. In any case, the organizer is not obliged to determine correct contact details. The data will be saved by the organizer until the event is finally completed. a. privacy The data provided by the participant will be treated in accordance with the data protection declaration , which the participant has viewed on the website www.sonymusic.de/Datenschutz and explicitly and separately accepted. b. Use of the winner's name etc. In the event that the participant wins, the participant already gives his permission to use his name and / or image in connection with the win on the part of the organizer or the artist / band concerned (homepage, Twitter, Facebook, YouTube, MySpace, etc.). ) is published. In the case of an action on social networks, such as Facebook or Twitter, permission is also given to link the participant's profile. c. Revocation regarding data The participant can revoke the consent to the collection and storage of the data at any time by revoking it. The organizer will then delete the participant's data. This also ends participation in the campaign. If the deletion of the data is contrary to legal regulations, the data will in any case be blocked with regard to further use. d. No liability for obtaining the data The organizer is not liable for technical problems in the transmission of content, as well as the availability or freedom from errors of the competition websites. 6. Submission of content In some cases, participation in campaigns requires the submission of contributions and / or material. The following applies in this regard: a. No unauthorized content In the context of the campaigns, it is forbidden to transmit or make accessible content that is criminal, pornographic, harmful to young people, racist or otherwise extremist or discriminatory. b. Copyrights, rights of use (including trademark rights, etc.) The participant ensures and is responsible for the fact that he is the sole holder of all rights of use and exploitation of the content he has transmitted. In particular, it may not contain any brands, protected labels, industrial property rights, works protected by copyright or ancillary copyright or other intellectual property of third parties, unless the rights holder has given unreserved consent. In this respect, he releases the organizer from all claims by third parties. Contributions that violate such rights of third parties or, in the opinion of the organizer, could violate them will be excluded from participation at the discretion of the organizer. The participant undertakes to c. Non-exclusive granting of rights to use The participant transfers to the organizer, free of charge, a simple, irrevocable, transferable right to use the transmitted content that is unlimited in terms of time, location and content. Statutory claims remain unaffected. d. Property rights Material transmitted or sent to the organizer becomes the property of the organizer without restriction. The organizer is not obliged to return material that has been sent in. e. Exclusion of individual contributions The organizer is entitled at its own discretion to exclude individual contributions from participation, in particular if they violate the conditions of participation. f. No liability for acquisition The organizer is not liable for technical problems in the transmission of content, as well as the availability or freedom from errors of the competition websites. The participant guarantees that he will not transmit any content that contradicts the above principles to the organizer. 7. Reservation of changes / cancellation of prizes / conditions The organizer reserves the right to change, cancel or extend the campaign or conditions of participation at any time without giving reasons, especially if proper implementation is no longer possible for technical and / or legal reasons. In such a case, a possibly already determined winner is not entitled to any claims against the organizer. 8. Determination of the winners The winners will be determined by the organizer, his employees, vicarious agents or commissioned third parties. The special conditions of participation regulate the details. 9. Notification, Acceptance Period / Expiration The winner will be notified by post, telephone, email, fax, Facebook or other means. The notification usually takes place within three working days of the deadline. If the winner cannot be reached and / or does not accept the prize within a period of 2 days, the prize expires and a new winner is determined. 10. Exclusions Regarding Profit a. No payout or reimbursement A payment of the monetary value is not possible. No additional costs and expenses beyond the price, such as travel, food or similar costs, will be reimbursed, unless they are expressly part of the price. The participant has to bear such costs himself. b. Exclusion of legal action The judges' decision is final. 11. Cooperation in campaigns The actions can be carried out in cooperation with various partners. In certain cases (e.g. if the prize is sent by the cooperation partner) it may be necessary to transmit the participants' data to the cooperation partner. The participant declares his consent to the transmission of participant data to such cooperation partners. The organizer is not liable for incorrect information that is disseminated by cooperation partners. 12. Conditions for competitions on Facebook, Instagram, Tik Tok, Futurestream, or Twitch By participating, the participant undertakes to comply with the guidelines of platforms listed above or in which are utilized for the pitch/performance/competition in a virtual manner. Actions on virtual platforms are in no way related to the platforms utilized. They are in no way sponsored, supported or organized by the platforms and do not establish any legal claims against the platforms utilized. All information in the context of this competition is provided exclusively by the organizer. These platforms are also not available as a contact person for the respective campaign. Any inquiries regarding the competition should be directed to the organizer. 13. Disclaimer of Liability In the provision and implementation of the prizes, the organizer excludes liability for slightly negligent breaches of duty, provided that these do not concern essential contractual obligations, damage from injury to life, limb or health or guarantees or claims under the Product Liability Act are affected. The same applies to breaches of duty by vicarious agents of the organizer. 14. Miscellaneous German law applies. The place of jurisdiction - as far as this is permissible - for all disputes arising in connection with the campaign is Berlin, Germany.
